Federal appeals court keeps e-books pricing conspiracy ruling against Apple intact

Apple's hopes of overturning the 2013 court ruling that it conspired with major book publishers to raise the price of e-books were dashed today. The Second U.S. Circuit Court of Appeals in Manhattan has ruled 2-1 to uphold the original decision in the case.

According to The Wall Street Journal:

"We conclude that the district court correctly decided that Apple orchestrated a conspiracy among the publishers to raise e-book prices," wrote Second Circuit Judge Debra Ann Livingston. The conspiracy "unreasonably restrained trade" in violation of the Sherman Act, the federal antitrust law, the judge wrote.

That means Apple will have to abide by its previously agreed upon settlement, where it will have to pay $450 million. mostly to e-book buyers.
